Terms and Conditions
The following Conditions and information form the basis of your Booking Contract with YouGolfTours GmbH (hereinafter: “YouGolfTours”). Please read these terms carefully as they contain the respective obligations. The Booking Conditions apply within the framework of our contract with you and everyone named when you make your Booking. The contract comes into force as soon as we have received and confirmed your deposit. This contract is subject to Swiss Law. Any disputes are subject to the jurisdiction of the Swiss courts.
Subject of the contract
According to the Booking confirmation, we undertake to provide you with the agreed green fees, accommodation and any other confirmed service.
Conclusion of contract
The contract between you and YouGolfTours comes into being when you receive your Booking confirmation in writing, and the rights and obligations under the contract for the persons entered in the Booking confirmation and YouGolfTours become effective. If you are mediated by other tour operators or airlines through our travel arrangements, their own travel and contractual Condition’s apply.
The flat rates are listed per person, in Swiss Francs and apply to cash payments or bank transfers. We would like to kindly point out that in addition to our Booking prices, reservations – processing fees may be levied in accordance with the guidelines of the SRV (Swiss Association of Travel Agents). The total price is to be paid 100% until 14 days before the start of the trip. The documents will be sent after receipt of payment. In special cases a price increase may result (e.g. national duties or taxes etc.). If the price increase exceeds 10% of the total price confirmed by us, you have the right to withdraw from the contract free of charge within 5 working days of receiving the notification.
Vacation content and website accuracy
While we reserve the right to change our prices at any time due to exchange rate fluctuations or other unforeseen costs, the price of your vacation stated on your Booking confirmation and invoice will only be changed if government taxes, duties, levies and any changes in fees by transport companies change , Subcontractors, agents or if you make changes to your vacation yourself. The prices and information displayed on our website, as well as all other promotional materials published by us, may have changed at the time of Booking. Every effort is made to ensure the accuracy of the prices. However, errors occur. So please check the price and details of your vacation at the time of Booking.
If you have a complaint, you must immediately notify the hotel, golf course, transport company, YouGolfTours or our local representatives so that the problem can be resolved immediately. If the problem cannot be resolved on site, we must receive all complaints in writing within 7 days of your return from your golf vacation. We cannot consider complaints or claims for damages if we have not been notified during your stay and have received written notification within the period described above.
We accept responsibility for the agreements provided for in this contract and for ensuring that these agreements achieve an appropriate standard, regardless of whether the services are provided by us or by our agents or suppliers. If any part of your golf vacation is not as stated and / or confirmed on your Booking confirmation, we will provide reasonable compensation. If an event has adversely affected the enjoyment of your golf vacation, we accept liability up to a maximum amount of the golf vacation costs. We take responsibility for the actions of our employees, agents, and suppliers unless they result in death, injury, or illness. Our liability is limited in any case to the costs of your travel preparations that have been booked with YouGolfTours. We shall not be liable if this is caused by the act (s) and / or omission (s) of the data subject (s) or that of a third party that are not related to the provision of your golf vacation and that was unforeseeable or unavoidable or an event that either we ourselves or the provider of the service (s) in question could not have foreseen or avoided despite all due care.
Cancellation request from customers
The declaration of revocation only becomes effective if it is received in writing. As costs are incurred from the time your booking is confirmed, the following cancellation fees apply: If the cancellation fee is expressed as a percentage, this will be calculated from the total costs payable by the person (s) canceling, excluding any change fees. Period before the start of the journey in which we receive the cancellation in writing (the days are calculated in natural working days):
60-21 days before departure: 15% of the confirmed total price
20-14 days before departure: 30% of the confirmed total price
13 – 7 days before departure: 45% of the confirmed total price
6 – 0 days before departure: 100% of the confirmed total price
If you do not start the trip or rebook, you owe YouGolfTours a processing fee of CHF 99,- per person booked or CHF 220,- per order. Depending on the reason for the cancellation, you may be able to reclaim these cancellation fees (minus any excess) under the terms of your insurance policy. Claims must be made directly to your insurance company. Please let us know if you need a cancellation invoice for your insurer. If, as a result of a cancellation, the number of full paying people is reduced to below the number on which the price or the discounts agreed for your booking are based, we will recalculate these items and invoice you accordingly. We reserve the right to special cancellation and rebooking conditions for groups or for individual services (e.g. special flight fares, round trips, etc.).
YouGolfTours cannot reimburse the price for the golf trip if you interrupt your trip prematurely for certain reasons. If possible, we will reimburse you for any unused services (please note the possibility of taking out return travel insurance).
Changes or cancellations by YouGolfTours
From time to time it may be necessary to change details of your trip and we reserve the right to do so. We will notify you immediately of any major changes. A significant change is a change in the departure airport or a difference of more than twelve hours to the departure time or a change in the hotel. A material change does not include any government-influenced changes to the airport or flight schedule, or a change in accommodation imposed on us by a supplier. If you are affected by a major change, you can choose between: A) Accept the amended agreement as notified. B) Purchase another available golf vacatinon-refundable airline tickets). If we need to make a major change or cancel, your Golf Vacation Compensation will not be payable and no liability will be accepted beyond offering the above options if we are forced to make a change or cancel due to force majeure. No compensation will be paid if we cancel due to your failure to comply with a requirement in our booking conditions that entitles us to cancel (e.g. paying on time) or if the change made is minor. A minor change is one that we cannot reasonably expect to have a material effect on your confirmed golf vacation at the time of booking.
For hotel reservations without a flight, we charge a fee of CHF 60,- per hotel, with a maximum of CHF 220,- per order. If services have to be requested separately for short-term bookings (less than 7 days before departure), we will charge you a fee of CHF 70,- for telephone / expenses
Place of Jurisdiction
In the relationship between you and YouGolfTours, is the Swiss Law exclusively applicable. Lawsuits against YouGolfTours can only be brought at our headquarters in Martigny (Valais, Switzerland).on from us c. Cancellation of your golf vacation which may incur fees (e.g.)
